 Considering the well-settled rule that what determines the nature of action are the allegations of the complaint or petition, and the character of the relief sought,2 [Union Bank of the Philippines v. Court of Appeals, 290 SCRA 198 (1998).] and considering the interest of justice, we accordingly treat this petition as a special civil action for certiorari under Rule 65.
